These terms of use agreement (this “Agreement”) is a legal agreement between the person and the school or other education provider named as the "School" upon registration (the “Customer”) and Assessinator.co.uk, 41 Swallow Court, St Neots PE19 1NP, United Kingdom for the use of assessinator.co.uk.

By using and/or registering to use Assessinator.co.uk, the Customer (the person and the school or education provider) must read, agree with and accept all of the terms of use contained in this Agreement. The Customer agrees that any use of assessinator.co.uk shall constitute their and their school's or education provider's acceptance of this Agreement. Assessinator.co.uk recommends that the Customer store or print-off a copy of this Agreement for their records.

If the Customer does not agree to the terms of this Agreement then please refrain from using Assessinator.co.uk.

Your acceptance of these terms will be accepted as if from the school or education provider, not just from you, an individual within the school or education provider. For this reason, you must show this Agreement and seek acceptance of these terms and conditions from the appropriate personnel within your school or education provider.

Data and Data Protection

1. The Customer and Assessinator.co.uk warrants to the other that it shall comply with the provisions of applicable data protection law such as the General Data Protection Regulation 2016/679 (“GDPR”) and the Data Protection Act 1998 (“DPA”) with any future modification, consolidation or re-enactment thereof and shall indemnify the other Party against any reasonable losses, liabilities and costs which it suffers or incurs as a result of a breach of this Clause.
    
2. The Customer and Assessinator.co.uk shall take all reasonable steps to mitigate the risks of data loss inherent in its use of the website. The Customer agrees that Assessinator.co.uk shall not be liable for loss of Customer data to the extent that the Customer data has changed within 24 hours of a backup restoration.
    
3. Where Assessinator.co.uk processes personal data (as defined in the DPA) for and on behalf of the Customer, Assessinator.co.uk shall:
    
   1. process the personal data only on the instructions of the Customer;
   2. implement appropriate technical and organisational measures to protect the personal data against accidental or unlawful destruction or accidental loss, alteration, unauthorised disclosure or access, in particular where the processing involves the transmission of data over a network, and against other unlawful forms of processing;
   3. provide co-operation and assistance to the Customer in allowing data subjects (as defined in the DPA) to have access to those data and/or to ensure that those data are deleted or corrected if they are incorrect (or, if the Customer does not agree that they are incorrect, to have recorded the fact that the data subject considers the data to be incorrect);
   4. comply with any order, notice, assessment or other instruction of the Office of the Information Commissioner or any similar or equivalent body; and
   5. upon expiry or earlier termination of the Agreement and, on receipt of a written request, return to the Customer all the Customer’s data in its possession or control. Assessinator.co.uk shall return the Customer’s data:
      1. within such time period as the Customer may reasonably specify; and
      2. in any manner and/or medium as the Customer may reasonably specify.
          
4. In the event that the any data is extracted from the website the responsibility and liability for such removed data shall fall to the Customer.
